1. Acceptance

By accessing and using simai.com.ar (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site.

These terms govern use of the Site only. The provision of SIMAI's PAaaS (Precision Agriculture as a Service) is governed by a separate service contract executed between SIMAI and the contracting producer.

2. Site Description

The Site is an informational and commercial channel for SIMAI AgTech. Its purpose is to present SIMAI's services, facilitate contact with prospective clients, and publish content on agricultural technology. It does not process payments or execute subscriptions directly.

3. Intellectual Property

All content on the Site — including text, images, logos, design, source code, and the SIMAI brand — is the property of SIMAI AgTech or its licensors, and is protected by Argentine intellectual property law (Law 11,723 and related legislation).

Reproduction, distribution, modification, or commercial use of any Site content without prior written authorization from SIMAI is prohibited.

4. Acceptable Use

By using the Site, you agree to:

• Not use the Site for unlawful purposes or in violation of these Terms.
• Not attempt unauthorized access to SIMAI systems, servers, or databases.
• Not submit malicious content, spam, or false information through the contact form.
• Not perform mass automated scraping of Site content without prior written authorization.

5. Contact Form

The contact form is designed to receive commercial inquiries, evaluation requests, and general questions. By submitting it, you confirm that the information provided is accurate and that you are at least 18 years of age. SIMAI reserves the right not to respond to communications that are abusive, irrelevant, or in violation of these Terms.

6. Newsletter

By subscribing to the newsletter, you agree to receive periodic communications from SIMAI on agricultural technology, weather alerts, and service updates. You can unsubscribe at any time via the opt-out link in any email or by writing to info@simai.com.ar.

7. PAaaS Service — Contracts

Plan descriptions and features published on the Site are informational. The binding terms of the PAaaS service — including hardware scope, service levels, final pricing, renewal conditions, and responsibilities — are set out in the service contract signed between SIMAI and the producer. In the event of conflict between Site content and a signed contract, the contract prevails.

8. Content Accuracy

SIMAI makes reasonable efforts to ensure Site information is accurate and current. However, data on yields, savings, and agronomic outcomes published on the Site are estimates based on published scientific literature and do not constitute guarantees of specific results for any particular field or producer.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SIMAI will not be liable for direct, indirect, incidental, or consequential damages arising from use or inability to use the Site, including web service interruptions, typographical errors, or omissions in the content.

10. Privacy

The processing of personal data collected through the Site is governed by our Privacy Policy, which forms an integral part of these Terms.

11. Changes

SIMAI may modify these Terms at any time. Changes take effect upon publication on the Site. The date of last update is indicated at the top of this document. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute arising from them shall be submitted to the ordinary courts of the Autonomous City of Buenos Aires, and the parties waive any other jurisdiction that may apply.
